Important clauses which may limit our responsibility, place an obligation on you to indemnify us, involve an acknowledgement of any fact or involve some risk for you will be in bold and italics. You must pay special attention to these clauses.
1. INTRODUCTION
1.1. The Tropika Island of Treasure at Home Challenges Competition (“Competition”“) is being run by Clover S.A Proprietary Limited, Registration Number 1994/001064/07 (“Organiser/we/us/our”).
1.2. Each person entering the Competition (“participants/entrants/you/your”) and/or accepting any prize in terms of the Competition, agrees and accepts that the Competition rules as set out in these terms and conditions (“Rules”) are binding on him or her.
1.3. Copies of these Rules are available online at clover.co.za (“Website”) or at Clover Park, 200 Constantia Drive, Constantia Kloof.
2. COMPETITION PERIOD
2.1. The Competition will run for a 12-week period, starting on 17 September 2022 and ending on 10 December 2022 (“Competition Period”).
2.2. The Competition and Competition Period will be broken up into 12 x competitions, each running for 1 week at a time, being from 18h30 on Saturday to 23:59 the following Saturday (“Weekly Competition Periods”).
2.3. The weekly competitions within the Competition will take place across Tropika’s social during the broadcast of each episode of the Tropika Island of Treasure – every Saturday – and will outline the mechanics for entry as well as closing date and prize. The relevant social media pages are:
2.3.1.Facebook page (which can be located at https://www.facebook.com/tropikaisland);
2.3.2.Tropika Twitter Page (which can be located at https://twitter.com/MyTropika); and
2.3.3.Tropika Instagram Page (which can be located at https://www.instagram.com/mytropika/)
2.4. No entries received after the end of the Competition Period and/or the Weekly Competition Periods will be considered.
3. WHO CAN ENTER
3.1. In order to be eligible to enter the Competition you must:
3.1.1. be a legal, permanent resident of the Republic of South Africa;
3.1.2 be in possession of a valid identity document with a 13 (thirteen) digit identity number;
3.1.3 be 18 (eighteen) years old or older on the date you enter;
3.1.4 be a natural person; and
3.1.5 not be barred or disqualified by any authority from participating in the Competition and/or taking delivery and transfer of the prize(s) or any portion thereof available to be won during the Competition.
3.2. Notwithstanding clause 3.1, you are not eligible to enter this Competition if:
3.2.1 you are a director, member, partner, employee, agent or consultant of the Organisers, or any other person who directly or indirectly controls or is controlled by the Organisers;
3.2.2 you are an immediate family member of any of the persons specified in clause 3.2.1; or
3.2.3 you are an immediate family member of any of the persons specified in clause 3.2.1; or
3.3. Notwithstanding clauses 3.1 and 3.2, you are not eligible to enter this Competition if:
3.2.1 you are a director, member, partner, employee, agent or consultant of the Organisers, or any other person who directly or indirectly controls or is controlled by the Organisers;
3.2.2 you are an immediate family member of any of the persons specified in clause 3.2.1; or
3.2.3 you are a supplier of goods or services in connection with the Competition.
4. HOW TO ENTER
4.1. Recreate the At Home Challenge demonstrated in the weekly competition video, record you and your friends/family taking part and upload your version of the weekly challenge to your personal Instagram, Twitter and TikTok accounts within the competition period. Be sure to include #Tropika and tag @MyTropika in your post.
4.2. On Facebook, upload your version of the weekly challenge to the competition post as a comment and include #Tropika to enter.
4.3. Once you meet the requirements set out in clause 3 above and this clause 4, you will automatically be entered into the Competition.
4.4. There is no restriction on the number of times you may comment/enter during the Competition Period.
4.5. No automated entries will be allowed. Entries must be made manually by a natural person.
4.6. If your entry is submitted in a manner that in the sole discretion of the Organisers will provide you with an unfair advantage over other entrants, you will be disqualified from the Competition. The Organiser further reserves its rights, in its sole discretion, to remove any entries, posts and/or comments from any social media pages of the Organiser.
4.7. The costs of each entry will be for the account of the entrant, including standard internet costs.
5. DETERMINATION OF WINNERS
5.1. We will select 12 (twelve) entrants (Winners), across Facebook, Twitter, TikTok and Instagram from all valid entries received during the Competition Period. This is 1 winner per Weekly Competition Period and thus per week for the 12-week broadcast period.
5.2. The Organisers shall select the Winners in their sole discretion by way of a group of judges selected by the Organisers in its sole discretion (Judges) and which Judges shall determine which is the best and/or most original and/or most entertaining entry for the week. The decision of the judges is final.
5.3. We will notify the Winners by commenting on their entry post within 7 (seven) days from determination of the Winners to request copies of each Winner’s identification document in order to validate his/her entry, any other information requested and to request further contact details. Each Winner will be required to provide an electronic copy of his/her identification document and any other information requested within 2 (two) days from being requested by us to do so, failing which the Winner will forfeit the prize and have no claim against us.
5.4. If a Winner does not reply to the notification message sent by us within 2 (two) days of it being sent by us, that Winner will forfeit the prize and will have no claim against us. In the event of a forfeiture as contemplated herein, we shall have the right, but shall not be obliged, to select a different entrant on the same conditions.
5.5. The Winners may, at the sole discretion and election of the Organiser, also be announced on the Tropika social media pages and live on Expresso Show once the Winners are confirmed. By entering the Competition you (a) consent to the announcements on the social media platforms and the Expresso Show and (b) you consent and agree to your name, image (if applicable) and contact details being collected, used, stored and processed by the Organisers for purposes of the Competition.
5.6. By selecting to enter the Competition, you consent and agree to your name and image (where applicable) and contact details being collected, used, stored and processed by the Organisers for purposes of the Competition as well as marketing purposes in relation to Tropika Island of Treasure Season 10 All Stars
6. THE PRIZE
6.1. Subject to clause 5:
6.1.1. for the first Weekly Competition Period (being 17 t0 24 September 2022), the prize which the selected Winner will receive is a R10 000.00 (ten thousand Rand) voucher, which will be shared via SMS and can be used within the Uber app;
6.1.2.for the remainder of the Weekly Competition Periods, a cash prize of R1 000 (one thousand Rand) will be received by each of the 10 (ten) Winners will each receive a R1 000.000 (one thousand Rand) cash prize. This is for the Winners selected in weeks 2-11 of the 12-week broadcast period; and
6.1.3. the Judges will select 2 of the Winners from the first 11 weeks of the Competition, who will all be invited to take part in a finale challenge on the Expresso Show, where the winner will walk away with an AEG fridge worth R9,000, stocked with Tropika.
6.2. All prizes to be won during the Competition shall be referred to collectively as the Prize.
6.3. The Prize excludes all items not mentioned in clause 6.1 and may differ from images or items used in marketing material for the Competition.
6.4. We will contact the Winners to receive all necessary information to deliver the Prize and the Prize shall be delivered to the Winner at an address within the Republic of South Africa within 30 (thirty) business days from confirmation of the Winners. For the 10 x Cash prizes, bank details will need to be supplied by the winners so an EFT can be done to the Winner.
6.5. The Prize, or any part thereof, may not be exchanged for any other item. Prizes are not transferable. We reserve the right to substitute the Prize, or part thereof, with any other prize of a similar commercial value.
6.6. Any taxes and/or costs associated with the receipt of any Prize shall be for the account of the Winner.
7. GENERAL TERMS
7.1. The Organiser may in its sole discretion amend these Rules at any time, without notice, and such amendment(s) shall be deemed to have taken effect from the date of publication of the revised Rules on the Website.
7.2. The Organiser will interpret the Rules in their sole discretion and reserve the right to amend the Rules at any time should it be deemed necessary in the sole and unfettered discretion of the Organisers.
7.3. If you are not eligible to enter the Competition in terms of clause 3 above, you will forfeit any Prize that may be allocated to you in terms of this Competition. The Organisers reserve the right to request you to provide necessary proof that you have met the eligibility requirements. Should you fail to provide such proof within a reasonable time and/or the time period specified in these Rules, you will be disqualified and any Prizes will be forfeited and returned to the Organiser if applicable.
7.4. The Organiser may collect, store and use any personal information of entrants and/or other participants for communication or statistical purposes. By entering the Competition, you expressly consent to the aforesaid use.
7.5. In the event of a dispute, the decision of the Organiser will be final and binding and no correspondence and/or discussion will be entered into. In this regard and for further clarity, the Organiser shall be entitled to deal with such disputes (or any failure by participants to follow these Rules) in their sole discretion, including that the Organiser shall be entitled, in addition to any other rights which the Organiser may have in terms of these Rules and/or general competition rules, to immediately disqualify participants from the Competition.
7.6. By entering the Competition and/or accepting any Prize, the entrants, users and/or Winners hereby indemnify, release and hold harmless the Organiser (including its subsidiaries, holding companies and affiliates), its directors, employees, agents, suppliers and contractors (“Organiser Parties”) from and against any actions, claims and/or liability for injury, loss, damage, expense, claim and/or liability of any kind resulting in whole or in part, directly or indirectly, from participation in the Competition, and/or the use, acceptance or possession of a Prize, and/or participation (or non-participation) in a Prize-related activity.
7.7. The Organiser reserves the right to terminate the Competition at any time with immediate effect. If this is the case, the Organiser will provide a notice on the Website. It shall be the responsibility of entrants to review such Websites in this respect. In such event, all entrants hereby waive any rights which they may have against any of the Organiser Parties and acknowledge that they will have no recourse or claim of any nature against the Organiser Parties.
7.8. The Organiser is not liable for any technical failure that may result in an entry not being successfully submitted and/or selected.
7.9. Any Prize is accepted by a Winner at his/her own risk and the Organiser is not liable, at any time, for any defect in the Prize.
7.10. Where relevant:
7.10.1. if a Winner does not accept the Prize or is deemed not to accept the Prize;
7.10.2. if an entry is not valid for whatever reason;
7.10.3. if a Winner has breached these Rules;
7.10.4. if a Winner does something that amounts to hate speech, the incitement of violence is disparaging, discriminatory, harmful and/or unlawful and/or which, in the sole discretion of the Organiser does or may bring the Organiser Parties, Tropika, Tropika Island of Treasure Season 10 All Stars and/or the Competition into disrepute;
7.10.5. if a Winner renounces the Prize or we deem such Winner to have renounced the Prize, we reserve the right to declare the Prize forfeited and/or choose a new Winner.
7.11. Nothing in these Rules is intended to, or must be understood to, unlawfully restrict, limit or avoid any rights or obligations, as the case may be, created for either the entrants or the Organisers in terms of the Consumer Protection Act, 68 of 2008.
7.12. The duration of this Competition may also be extended or curtailed at the sole discretion of the Organiser. If this is the case, the Organiser will provide notice of this on the Website.
