CLOVER DAIRY LITTLE BIG COOK OFF INSTANT CASH COMPETITION (“Competition”)

By entering this Competition and/or accepting any prize, all participants, entrants and winners agree to be bound by the terms and conditions below (“Rules”) applicable to this Competition which is being run by Clover S.A Proprietary Limited, Registration Number 1994/001064/07 and/or its agencies (hereafter called “the Organiser”).

Copies of these Rules are available online at www.clover.co.za (“the Website”) or at Clover Park, 200 Constantia Drive, Constantia Kloof, Roodepoort.

You may not participate in this Competition if you do not agree to be bound by the Rules and if you enter this Competition or participate further in this Competition, doing so will be confirmation that you agree to these Rules.

The Organiser may in its sole discretion amend these Rules at any time, without notice, and such amendment(s) shall be deemed to have taken effect from the date of publication of the revised Rules on the Website.

1. Competition period
The Competition commences at 00:01 on 15 January 2015 and ends at 23:59 on 30 September 2015 (“Competition Period”). No entries received after the end of the Competition Period will be accepted.

2. Eligible Entrants
2.1. In order to be eligible for participation in this Competition an entrant must:
2.1.1. be a South African citizen or a permanent resident of South Africa;
2.1.2. be in possession of a valid South African identity document, or if a permanent resident, a valid passport;
2.1.3. subject to the provisions of clause 5.3, hold a valid South African bank account in his/her name;
2.1.4. undertake to abide by these Rules;
2.1.5. be 18 (eighteen) years of age or older or, if a minor, the entrant must be assisted to the extent necessary by a parent/legal guardian; and
2.1.6. consent to his or her name and contact details being used by the Organisers for purposes of being considered for Season 2 of the Clover Dairy Little Big Cook Off (“Clover Dairy Cook Off”) reality television series closed audition process (which process is subject to its own terms and conditions which shall be communicated to those entrants to this Competition who are successfully selected to be a part of the closed audition process as more fully contemplated in paragraph 6 below), failing which the winner shall forfeit the prize on the grounds of ineligibility. Each entrant represents and warrants that by entering in or participating in this Competition, he/she has full eligibility to do so. The Organisers reserve the right to request proof that entrants have met these eligibility requirements.

3. How to participate
3.1. To enter the Competition, and stand a chance of winning any of the prizes, eligible entrants will be required to:
3.1.1. purchase any 2 (two) Clover Dairy products (“the Products”); and
3.1.2. dial the USSD (Unstructured Supplementary Service Data) code (*120*605*substring number#) as stipulated on the Products. You will then be prompted to enter selected digits of the product barcode number for each of the Products. Once you have entered the requested combination of digits for each of the 2 (two) Products purchased, you will then be promoted to enter the names of the Products purchased, your name, age, gender and the name of the province you are currently residing in. [Note that you will have a maximum of 3 (three) attempts to enter the correct barcode numbers. After the third attempt, your cellular number will be blocked from entering the Competition and you will be required to contact the Organiser’s call centre and provide proof of purchase of the Products in order to unblock your number.]
3.2. Entrants may enter the Competition as many times as they like, provided that the unique code on any of the Products may only be used once.
3.3. Upon completion of the USSD session contemplated in paragraph 3.1, entrants will be automatically entered into an instant randomised draw for a chance to win a prize in accordance with paragraph 4 below for the remaining duration of the Competition Period.
3.4. Entry will be charged at 20c per 20 seconds. Free minutes do not apply. Cost of entry will not exceed R1.50 (one rand and fifty cents) in total.

4. Nature of prize and prize allocation
4.1. Subject to clause 4.3, entrants stand a chance of being 1 (one) of a total of 259 (two hundred and fifty nine) winners of instant cash to the value of R1000 (one thousand Rand) each, with 1 (one) winner being randomly selected daily for the duration of the Competition Period (“Daily Prize Allocation”) by way of a randomised draw which will take place between 05h00 and 21h00.).
4.2. The Competition prizes are not transferrable from the prize winners to any other person and may not be exchanged for its cash value.

5. Winners 
5.1. Winners of the Daily Prize Allocation will be notified within 30 (thirty) days of the randomised draw by way of a telephone call to the cellular number which was utilised by the winner in order to enter the Competition.
5.2. Winners will be requested to provide their email address in order for the Organisers to send through an Information Request, Consent & Indemnity Form for completion.
5.3. Within 7 (seven) working days of having been sent the Information Request, Consent & Indemnity Form, the winners must return to the Organisers a duly completed and signed form, together with a clear copy of their identity document (and in the event that the bank account details provided belong to a third party, a clear copy of the identity document of such third party account holder) by email to Faadil Namhing at FNamhing@foneworx.co.za. If the information is not provided within the prescribed time or the information provided is incomplete in any respect, the winner will automatically forfeit the Daily Prize Allocation and a runner up winner who has provided all information required will win the Daily Prize Allocation.
5.4. Winners will receive their prizes within 21 (twenty one) working days reckoned from the date from which winners email the documentation contemplated above by way of electronic funds transfer into the bank account details provided in the Information Request, Consent & Indemnity Form.
5.5. Note that no Daily Prize Allocation shall be paid in cash and as such, it is mandatory for winners to provide banking details in their Information Request, Consent & Indemnity Form, failing which they will forfeit their prize and the Organisers shall be entitled to award such forfeited prize to a runner up winner.
5.6. It is permissible for a winner to win the Competition more than once during the Competition Period, provided that a time period of one month has lapsed since the last time the winner has won the Competition.

6. Shortlisting for Season 2 of the “Clover Dairy Cook Off” closed audition process
6.1. When you enter the Competition before 15 April 2015, you will receive an SMS invitation from the Organisers requesting you to indicate whether you would like to be considered to be a part of the closed audition process for Season 2 of the “Clover Dairy Cook Off” reality television series. If you respond to the invitation with a “yes”, you will receive further instructions as well as the terms and conditions applicable to the closed audition process. If selected by the Organisers within their sole discretion for the first stage of the closed audition process, you could stand a chance to be 1 (one) of the lucky participants selected to be a part of the reality television series.
6.2. The stakes are high as the winner of the television series will win a share of prizes up to a total value of R1 000 000.00 (one million Rand).
6.3. For the sake of clarity, it is herewith recorded that entries for the Competition received after 15 April 2015 will not be considered for shortlisting for the closed audition process.

7. General terms
7.1. The Organiser will interpret the Rules in their sole discretion and reserve the right to amend the Rules at any time in accordance with the provisions contained in these Rules.
7.2. The Organiser, its directors, members, partners, employees, agents, consultants, any other person who directly or indirectly controls or is controlled by it or any supplier of goods and services in connection with this Competition and their spouses, life partners, parents, children, siblings, business partners or associates are not eligible to participate in or enter this Competition.
7.3. The Organiser may collect, store use and otherwise process any personal information of entrants and/or other participants for purposes of this Competition, communication and/or statistical purposes.
7.4. IN THE EVENT OF A DISPUTE, THE DECISION OF THE ORGANISER WILL BE FINAL AND BINDING AND NO CORRESPONDENCE WILL BE ENTERED INTO. IN THIS REGARD AND FOR FURTHER CLARITY, THE ORGANISER SHALL BE ENTILTED TO DEAL WITH SUCH DISPUTES (OR ANY FAILURE BY PARTICIPANTS TO FOLLOW THE RULES) IN THEIR SOLE DISCRETION, INCLUDING THAT THE ORGANISER SHALL BE ENTITLED, IN ADDITION TO ANY OTHER RIGHTS WHICH THE ORGANISER MAY HAVE IN TERMS OF THESE RULES AND/OR THE GENERAL COMPETITION RULES, TO IMMEDIATELY DISQUALIFY PARTICIPANTS FROM THIS COMPETITION. BY ENTERING THE COMPETITION AND/OR ACCEPTING ANY PRIZE, THE ENTRANTS, USERS AND/OR WINNERS HEREBY INDEMNIFY, RELEASE AND HOLD HARMLESS THE ORGANISER (INCLUDING ITS SUBSIDIARIES, HOLDING COMPANIES AND AFFILIATES), ITS DIRECTORS, EMPLOYEES, AGENTS, SUPPLIERS AND CONTRACTORS (THE “ORGANISER PARTIES”) FROM AND AGAINST ANY ACTIONS, CLAIMS AND/OR LIABILITY FOR INJURY, LOSS, DAMAGE, EXPENSE, CLAIM OR DAMAGES OF ANY KIND RESULTING IN WHOLE OR IN PART, DIRECTLY OR INDIRECTLY, FROM PARTICIPATION IN THE COMPETITION, AND/OR THE USE, ACCEPTANCE OR POSSESSION OF A PRIZE, AND/OR PARTICIPATION (OR NON-PARTICIPATION) IN A PRIZE-RELATED ACTIVITY.
7.5. ENTRANTS WHO, IN THE ORGANISERS’ SOLE DETERMINATION, ACT UNLAWFULLY, FRAUDULENTLY, IN BREACH OF THESE RULES OR OTHERWISE DISHONESTLY MAY BE DISQUALIFIED FROM PARTICIPATING IN THE COMPETITION AND SHALL NOT BE ELIGIBLE TO WIN ANY PRIZE OR BE CONSIDERED FOR SHORTLISTED AS A CANDIDATE FOR SEASON 2 OF THE “CLOVER DAIRY LITTLE BIG COOK OFF” REALITY TELEVISION SERIES.
7.6. THE ORGANISER RESERVES THE RIGHT TO TERMINATE THE COMPETITION AT ANY TIME WITH IMMEDIATE EFFECT. IF THIS IS THE CASE, THE ORGANISER WILL PROVIDE A NOTICE ON THE WEBSITE AND IT SHALL BE THE RESPONSIBILITY OF ENTRANTS TO REVIEW SUCH WEBSITE IN THIS RESPECT. IN SUCH EVENT, ALL ENTRANTS HEREBY WAIVE ANY RIGHTS WHICH THEY MAY HAVE AGAINST ANY OF THE ORGANISER PARTIES AND ACKNOWLEDGE THAT THEY WILL HAVE NO RECOURSE OR CLAIM OF ANY NATURE AGAINST THE ORGANISER PARTIES.
7.7. THE ORGANISER IS NOT LIABLE FOR ANY TECHNICAL FAILURE THAT MAY RESULT IN AN ENTRY NOT BEING SUCCESSFULLY SUBMITTED. ANY PRIZE IS ACCEPTED BY A WINNER AT HIS/HER OWN RISK AND THE ORGANISER IS NOT LIABLE, AT ANY TIME, FOR ANY DEFECT IN THE PRIZE.
7.8. The duration of this Competition may also be extended or curtailed at the sole discretion of the Organiser. If this is the case, the Organiser will provide notice of this on the Website. All Competition queries must be directed to Foneworx on 083 913 1727 between 08h00 to 16h30.
