Clover Amasi Golden Oldies Competition (“Competition”)
By entering this Competition and/or accepting any prize, all participants, entrants and winners agree to be bound by the terms and conditions below (“Rules”) applicable to this Competition which is being run by Clover S.A Proprietary Limited, Registration Number 1994/001064/07 and/or its agencies (hereafter called “the Organiser”). Copies of these Rules are available online at www.clover.co.za (“the Website”) or at Clover Park, 200 Constantia Drive, Constantia Kloof, Roodepoort. You may not participate in this Competition if you do not agree to be bound by the Rules and if you do enter this Competition or participate further in this Competition, doing so will be confirmation that you agree to these Rules.
The Organiser may in its sole discretion amend these Rules at any time, without notice, and such amendment(s) shall be deemed to have taken effect from the date of publication of the revised Rules on the Website.
1. Competition period
The Competition commences at 00:01 on 13 October 2014 and ends at 23:59 on 15 December 2014, (“Competition Period”). No entries received after the end of the Competition Period will be accepted.
2. Eligible Entrants
2.1. In order to be eligible for participation in this Competition an entrant must: 2.1.1. be a South African citizen or a permanent resident of South Africa; 2.1.2. be in possession of a valid South African identity document; 2.1.3. undertake to abide by these Rules; 2.1.4. be 18 (eighteen) years of age or older or, if a minor, the entrant must be assisted to the extent necessary by a parent/legal guardian; and 2.1.5. consent to his or her name and contact details being used by the Organisers for purposes of being considered as the Clover Amasi Golden Oldies (“Clover Amasi Golden Oldies”) competition winner, failing which the winner shall forfeit the prize on the grounds of ineligibility. Each entrant represents and warrants that by entering in or participating in this Competition, he/she has full eligibility to do so. The Organisers reserve the right to request proof that entrants have met these eligibility requirements.
3. How to participate
3.1. To enter the Competition, and stand a chance of winning any of the prizes, eligible entrants will be required to:
3.1.1. purchase any 1 (one) Clover Amasi product, (“the Product”); and to enter, dial the USSD (Unstructured Supplementary Service Data) code (*120*26274#) as stipulated on the Product. You will then be prompted to enter the unique code. Once you have entered the requested code, you will then be promoted to vote for your preferenced Mzansi Legend. [Note that you will have will be limited to one (1) download per cellphone number, but codes entered can also be redeemed for additional votes]
3.2. Entrants may enter the Competition as many times as they like, provided that Unique Code from the Product may only be used once.
3.3. Entry will be charged at 20c per 20 seconds. Free minutes do not apply.
4. Nature of prize and prize allocation
4.1. Subject to clause 4.3, the winner will be randomly selected and will win a street party to see their chosen Mzansi legend live. The random draw will take place on the 16th December 2014.
4.1. Participants of the competition will be requested to vote for:
4.1.1 Yvonne Chakachaka and be provided with her song, “Makoti” for Download (this is limited to 40 000 ringtones available for download)
4.1.2 Sipho Mabuse and be provided with his song, “Burn Out” for download (this is limited to 40 000 ringtones available for download)
4.1.3 Mbongeni Ngema and be provided with the song, “Stimela saseZola” for Download (this is limited to 40 000 ringtones available for download)
4.2. The Organiser reserves the right to change these legends at its own discretion without notice and publish such amendments on www.clover.co.za
4.3. The Competition prizes are not transferrable from the prize winners to any other person and may not be exchanged for its cash value
5. Winners
5.1. Winners will be called directly from the cellphone number used to vote within five (5) working days of the close of the competition as contemplated in clause 3.1.
5.2. Final delivery of the Street Party will be subject to the availability of the elements involved and negotiated with the winners and other parties concerned.
6. General terms
6.1. The Organiser will interpret the Rules in their sole discretion and reserve the right to amend the Rules at any time in accordance with the provisions contained in these Rules.
6.2. The Organiser, its directors, members, partners, employees, agents, consultants, any other person who directly or indirectly controls or is controlled by it or any supplier of goods and services in connection with this Competition and their spouses, life partners, parents, children, siblings, business partners or associates are not eligible to participate in or enter this Competition.
6.3. The Organiser may collect, store and use any personal information of entrants and/or other participants for communication or statistical purposes.
6.4. IN THE EVENT OF A DISPUTE, THE DECISION OF THE ORGANISER WILL BE FINAL AND BINDING AND NO CORRESPONDENCE WILL BE ENTERED INTO. IN THIS REGARD AND FOR FURTHER CLARITY, THE ORGANISER SHALL BE ENTILTED TO DEAL WITH SUCH DISPUTES (OR ANY FAILURE BY PARTICIPANTS TO FOLLOW THE RULES) IN THEIR SOLE DISCRETION, INCLUDING THAT THE ORGANISER SHALL BE ENTITLED, IN ADDITION TO ANY OTHER RIGHTS WHICH THE ORGANISER MAY HAVE IN TERMS OF THESE RULES AND/OR THE GENERAL COMPETITION RULES, TO IMMEDIATELY DISQUALIFY PARTICIPANTS FROM THIS COMPETITION. BY ENTERING THE COMPETITION AND/OR ACCEPTING ANY PRIZE, THE ENTRANTS, USERS AND/OR WINNERS HEREBY INDEMNIFY, RELEASE AND HOLD HARMLESS THE ORGANISER (INCLUDING ITS SUBSIDIARIES, HOLDING COMPANIES AND AFFILIATES), ITS DIRECTORS, EMPLOYEES, AGENTS, SUPPLIERS AND CONTRACTORS (THE “ORGANISER PARTIES”) FROM AND AGAINST ANY ACTIONS, CLAIMS AND/OR LIABILITY FOR INJURY, LOSS, DAMAGE, EXPENSE, CLAIM OR DAMAGES OF ANY KIND RESULTING IN WHOLE OR IN PART, DIRECTLY OR INDIRECTLY, FROM PARTICIPATION IN THE COMPETITION, AND/OR THE USE, ACCEPTANCE OR POSSESSION OF A PRIZE, AND/OR PARTICIPATION (OR NON-PARTICIPATION) IN A PRIZE-RELATED ACTIVITY.
6.5. THE ORGANISER RESERVES THE RIGHT TO TERMINATE THE COMPETITION AT ANY TIME WITH IMMEDIATE EFFECT. IF THIS IS THE CASE, THE ORGANISER WILL PROVIDE A NOTICE ON THE WEBSITE AND IT SHALL BE THE RESPONSIBILITY OF ENTRANTS TO REVIEW SUCH WEBSITE IN THIS RESPECT. IN SUCH EVENT, ALL ENTRANTS HEREBY WAIVE ANY RIGHTS WHICH THEY MAY HAVE AGAINST ANY OF THE ORGANISER PARTIES AND ACKNOWLEDGE THAT THEY WILL HAVE NO RECOURSE OR CLAIM OF ANY NATURE AGAINST THE ORGANISER PARTIES
6.6. THE ORGANISER IS NOT LIABLE FOR ANY TECHNICAL FAILURE THAT MAY RESULT IN AN ENTRY NOT BEING SUCCESSFULLY SUBMITTED. ANY PRIZE IS ACCEPTED BY A WINNER AT HIS/HER OWN RISK AND THE ORGANISER IS NOT LIABLE, AT ANY TIME, FOR ANY DEFECT IN THE PRIZE
6.7. The duration of this Competition may also be extended or curtailed at the sole discretion of the Organiser. If this is the case, the Organiser will provide notice of this on the Website.
