Important clauses which may limit our responsibility, place an obligation on you to indemnify us, involve an acknowledgement of any fact or involve some risk for you will be in bold and italics. You must pay special attention to these clauses.
1. INTRODUCTION
1.1. The Krush Unlock Your 100% 2022 Competition (“Competition“) is being run by Clover S.A Proprietary Limited, Registration Number 1994/001064/07 (“Organiser/we/us/our”) in conjunction with JupiCorp Proprietary Limited T/A TMARC, Registration Number 2009/023775/07 (“Promoters”).
1.2. Each person entering the Competition (“participants/entrants/you/your”) and/or accepting any prize in terms of this Competition, agrees and accepts that the Competition rules as set out in these terms and conditions herein (“Rules”) is binding on him or her.
1.3. Copies of these Rules are available online at clover.co.za (“Website”) or at Clover Park, 200 Constantia Drive, Constantia Kloof.
1.4. The Competition shall consist of (a) the chance for entrants to win prizes, as described in these Rules (“Instant Prize Competition”) and (b) to be part of the Unlock Your 100% programme (“Krush Programme”) via the WhatsApp video submission or social media submission element (“Programme Competition”). The Krush Programme shall take place in the Republic of South Africa (“South Africa”). It being further acknowledged that the Organiser may provide for additional rules for the Competition, including without limitation any rules applicable during the Programme Competition and which rules shall be binding on the entrants.
2. COMPETITION PERIOD
2.1. The Instant Prize Competition as well as the period in which entrants can enter for a chance to participate in the Programme Competition commences at 00:01 on 1 September 2022 and will close at 23:59 on 31 December 2022 (“Competition Period”). No entries received after the end of the Competition Period will be considered.
2.2. During the Competition Period, video submissions for the Programme Competition will also be received and no video submissions received after the end of the Competition Period will be considered. However, the period of the Programme Competition and thus the period in which the selected entrants shall be participating in the Programme Competition shall be determined at the sole discretion of the Organiser and as communicated to the selected entrants from time to time.
3. WHO CAN ENTER THE INSTANT PRIZE COMPETITION
3.1. In order to be eligible to enter the Competition you must:
3.1.1. be a legal, permanent resident of the Republic of South Africa;
3.1.2. be in possession of a valid identity document with a 13 (thirteen) digit identity number;
3.1.3. be 18 (eighteen) years old or older on the date you enter or, if you are younger than 18 (eighteen) years of age, you must be assisted to the extent necessary by a parent/legal guardian;
3.1.4. be a natural person, and
3.1.5. not be barred or disqualified by any authority from taking delivery and transfer of the prize to be won during the Competition or any portion thereof.
3.2. Notwithstanding clause 1, you are not eligible to enter this Competition if:
3.2.1. you are a director, member, partner, employee, agent or consultant of the Organisers and/or Promoters, or any other person who directly or indirectly controls or is controlled by the Organisers and/or Promoters;
3.2.2. you are an immediate family member of any of the persons specified in clause 2.1; and/or
3.2.3. you are a supplier of goods or services in connection with the Competition.
4. HOW TO ENTER THE INSTANT PRIZE COMPETITION
4.1. In order to enter, purchase a promotional pack of Krush (“the Product”) and find the barcode. A list of which Products shall be deemed to be a promotion pack is set out in clause 5
4.2. Once you find the product barcode on the Product you purchased, dial the USSD (Unstructured Supplementary Service Data) code *120*809#, from a mobile phone. Participants will then be required to enter the last 4 digits of their Krush Product barcode.
4.3. Follow the onscreen prompts and complete the requested inputs.
4.4. You may enter the Instant Prize Competition as many times as you like, provided you use a different barcode per entry as found on purchased Products. In other words, there is only one entry per Product purchased.
4.5. You may be required to produce a valid receipt and/or till slip as proof of purchasing the Product with the associated barcode used for the entry, if requested by or on behalf of the Organisers. Failure to produce proof of purchase on request will result in disqualification of the entry.
4.6. All costs associated with the entry will be for the account of the entrant. It being recorded that each entry submitted will be charged at 20c (twenty cents) per 20 (twenty) seconds. Free minutes do not apply.

6. DETERMINATION OF PRIZE WINNERS
6.1. Winners of the Instant Prize Competition shall be selected instantly by means of an instant automated system throughout the Competition Period. Winners are therefore determined instantly on completion of their entries.
6.2.The prizes vary in value and are awarded completely randomly via the mobile USSD mechanic portion of the Competition. The prizes shall be awarded on a daily and weekly basis during the Competition Period.
6.3. Entrants of the Instant Prize Competition stand a chance to win a share of:
6.3.1. R270,000 (Two Hundred and Seventy Thousand Rand) in instant cash, which will be awarded in increments of R100, R200 and R500 to the lucky winners and which consist of:
6.3.1.1. 1 of 700 x R100 (On Hundred Rand) instant cash prizes;
6.3.1.2. 1 of 500 x R200 (Two Hundred Rand) instant cash prizes; and
6.3.1.3. 1 of 200 x R500 (Five Hundred Rand) instant cash prizes; and
6.3.2. grand/physical prizes, of:
6.3.2.1. Kenwood Slow Juicer, 3 to be won to the value of approximately R7,380.00 each;
6.3.2.2. Kenwood Hand Mixer, 3 to be won to the value of approximately R595.00 each;
6.3.2.3. Kenwood Mini Chopper, 4 to be won to the value of approximately R1,050.00 each;
6.3.2.4. Kenwood Bread Maker, 3 to be won to the value of approximately R1,750.00 each;
6.3.2.5. Kenwood Airfryer Double, 3 to be won to the value of approximately R4,099.00 each; and
6.3.2.6. Kenwood Titanium Chef Baker, 1 to be won to the value of approximately R16,699.00.
6.4. The Organiser reserves the right at any time, in its sole discretion, to exchange any of the prizes set out above for any other prizes of similar value.
6.5. Winners will need to have a valid South African bank account and if deemed to be a winner will be required to provide valid bank details to the Promoter in order to effect payment.
6.6 The Competition prizes are not transferrable from the prize winners to any other person and may not be exchanged for its cash value, except if otherwise stipulated in these Rules.
6.7. The winner or participants of the Instant Prize Competition are required to take part in publicity for broadcast, marketing or publishing purposes, which is conditional upon their agreement to take part in such publicity. Winners of instant prizes are also required to submit a photograph of themselves within 24 hours of being notified that they have won, failure to do so may result in the forfeiting of the prize. Winners or participants that take part in any publicity will not be entitled to any payment or other remuneration for such publicity or otherwise. All publicity and other materials will be the sole property of the Organiser.
6.8. By entering into the Competition, you hereby consent to the Organisers making use of your name, image, likeness and/or picture in any manner whatsoever in connection with the marketing activities of the Organisers regarding the Competition.
7. DELIVERY OF PRIZES
7.1. Winners of the Prizes will receive an SMS notification, to the number on which they submitted the entry, of the prize as well as a call from the Promoters to inform them of the win.
7.2. A winner will be required to submit a physical address in South Africa for the purposes of having their prize delivered, to the extent that the prize is a physical prize. Any cash prize will be paid by way of electronic transfer of funds into the confirmed bank account of the winner.
7.3. Winners must allow for up to 6 weeks for the delivery of prizes.
7.4. Should:
7.4.1. the Organiser and/or an authorised third party of the Organiser (including the Promotor) not be able to get hold of the winner on the cellular phone number used to enter the Instant Prize Competition; and/or
7.4.2. the winner inform the Organiser and/or an authorised third party of the Organiser that they do not accept the relevant prize; and/or
7.4.3. the winner not accept the prize and/or refuse to provide the Organiser and/or an authorised third party of the Organiser an address in South Africa at which the prize can be delivered and/or fail to provide confirmation of banking details and/or the required picture of themselves; and/or
7.4.4. the winner not accept the delivery of the grand prize at the nominated address in South Africa,
the winner shall be deemed to have not accepted the prize.
8.PROGRAMME COMPETITION
8.1. General
Entrants may select to submit their video submission to stand a chance to participate in the Programme Competition, either through (a) WhatsApp or (b) Facebook, Instagram or Twitter, as set out below.
8.2. Direct to WhatsApp
8.2.1. Entrants may submit video submissions by following the prompts as part of the USSD process for the entry into the Instant Prize Competition.
8.2.2. On completion of the relevant prompts, each participant will receive an SMS with instructions to enter via WhatsApp. Alternatively, entrants can take a scan of the QR code behind the label of the purchased Products and this will direct them to the WhatsApp line.
8.2.3. To stand a chance to be part of the show via WhatsApp, all participants need to click on the link within the SMS (https://wa.me/27828578054) and submit their video telling the Clover Krush team their dream and why Krush should choose them.
8.2.4. Content and video material cannot be submitted on behalf of someone else.
8.2.5. Submissions via WhatsApp will be assessed and entrants chosen in the sole discretion of the Organiser. All chosen contestants will be contacted telephonically on the cellular phone number provided by the entrant.
The cost (including data) of submitting video submissions via WhatsApp is for the account of the entrant
8.3. Facebook, Instagram or Twitter
8.3.1. Entrants may post their video submission on Facebook @CloverKrush, Instagram @CloverKrush and/or Twitter @CloverKrush using the hashtag #Krush and tell us what your dream is and why the Organiser should select you.
8.3.2. Content and video material cannot be submitted on behalf of someone else.
8.3.3. Submissions to these platforms will be assessed and entrants chosen in the sole discretion of the Organiser. All chosen entrants will be contacted telephonically on the cellular phone number provided by the entrant.
8.3.4. The cost of submitting video submissions via any of the social media platforms mentioned above is for the account of the entrant.
8.4. Additional Prizes
Entrants who enter to be part of the Programme Competition in terms of these Rules, i.e. stand a chance to win a share of a cash prize of R130,000 (One Hundred and Thirty Thousand Rand). Winners will each receive R10,000 (Ten Thousand Rand) and there will be 13 winners.
8.5. Requirements
8.5.1. In order to be eligible for section as contestants in the Programme Competition, entrants must:
8.5.1.1. be a legal, permanent resident of South Africa;
8.5.1.2. be in possession of a valid identity document with a 13 (thirteen) digit identity number;
8.5.1.3. be 18 (eighteen) years of age or older, at the date on which you submit your video;
8.5.1.4. be a natural person, and
8.5.1.5. not be barred or disqualified by any authority from participating in the Programme Competition and/or taking delivery and transfer of the prize to be won during the Competition or any portion thereof.
8.5.2. Notwithstanding clause 5.1, you are not eligible to enter the Programme Competition if:
8.5.2.1. you are a director, member, partner, employee, agent or consultant of the Organisers and/or Promoters, or any other person who directly or indirectly controls or is controlled by the Organisers and/or Promoters;
8.5.2.2. you are an immediate family member of any of the persons specified in clause 5.2.1; or
8.5.2.3. you are a supplier of goods or services in connection with the Competition.
8.6. Compliance and consent
8.6.1. By selecting to make yourself available to be considered for the Programme Competition, you confirm and agree that:
8.6.1.1. you shall comply with all applicable laws in relation to the Programme Competition and your participation therein; and
8.6.1.2. you shall comply with protocols and/or policies of South Africa, the Organiser and/or any third party contractor of the Organiser in connection with the Programme Competition,
and the Organiser shall not be liable for any compliance by you with the above.
8.7. By selecting to make yourself available to be considered for the Programme Competition, you consent and agree to your name, image, video submission and all content of your video submission and contact details being collected, used, stored and processed by the Organisers for purposes of the Programme Competition as well as its marketing activities.
8.8. You acknowledge that the Organiser may use video submission material for publicity purposes and/or to broadcast as part of the Programme Competition and/or marketing by the Organiser. By submitting your video submission and/or participating in the Programme Competition you acknowledge that the Organiser will own intellectual property rights (including copyright) to any such material which may include your participation (“your contribution”). You irrevocably consent and agree to the Organiser using, editing, broadcasting, publishing and/or exploiting your contribution in any media in perpetuity throughout the world and without any compensation to you. By submitting your video submission and/or participating in the Programme Competition, you waive any intellectual property rights to your contribution to and in favour of the Organiser (including any moral rights to your content).
8.9. Selection and format of the Programme Competition
8.9.1. Entrants shall be selected to participate in the Programme Competition at the sole discretion of the Organisers.
8.9.2. The format of the Programme Competition, how entrants selected to participate in the Programme Competition shall participate in the Programme Competition, the tasks and challenges involved and whether or not a competition entrant participates by him/herself or in a pair or in a team shall be determined in the sole discretion of the Organizer from time to time.
8.10. Participation in the Programme Competition and disqualification
8.10.1. Should you be invited as a participant for the Programme Competition, you will be provided with a Participation Agreement that will stipulate the specific terms and conditions for participation in the Programme Competition. Your participation in the Programme Competition will be subject to you agreeing to and signing the Participation Agreement.
8.10.2. The Organiser reserves the right to disqualify any participant from the Programme Competition for any reason whatsoever, including for breaches of these Rules and/or the Participation Agreement and/or any other rules determined by the Organiser from time to time.
8.10.3. You further acknowledge you may be eliminated from the Programme Competition in terms of the programme format and relevant rules applicable.
9. GENERAL TERMS
9.1. The Organiser may in its sole discretion amend these Rules at any time, without notice, and such amendment(s) shall be deemed to have taken effect from the date of publication of the revised Rules on the Website.
9.2. The Organiser will interpret the Rules in their sole discretion and reserve the right to amend the Rules at any time should it be deemed necessary ion the sole and unfettered discretion of the Organisers.
9.3. If you are not eligible to enter the Competition in terms of these Rules, you will forfeit any prize that may be allocated to you in terms of this Competition and shall not be entitled to participate in the Programme Competition. The Organisers reserve the right to request you to provide necessary proof that you have met the eligibility requirements. Should you fail to provide such proof within a reasonable time, you will be disqualified, and any prizes will be forfeited and returned if applicable.
9.4. The Organiser may collect, store and use any personal information of entrants for communication, statistical and/or marketing purposes. By entering the Competition, you expressly consent to the aforesaid use.
9.5. In the event of a dispute, the decision of the Organiser will be final and binding and no correspondence and/or discussion will be entered into. In this regard and for further clarity, the Organiser shall be entitled to deal with such disputes (or any failure by participants to follow the Rules) in their sole discretion, including that the Organiser shall be entitled, in addition to any other rights which the Organiser may have in terms of these Rules and/or the general competition rules, to immediately disqualify participants from this Competition.
9.6. By entering the Competition and/or accepting any prize, the entrants, users and/or winners hereby indemnify, release and hold harmless the Organiser (including its subsidiaries, holding companies and affiliates), its directors, employees, agents, suppliers and contractors ( “Organiser Parties”) from and against any actions, claims and/or liability for injury, loss, damage, expense, claim and/or liability of any kind resulting in whole or in part, directly or indirectly, from participation in the Competition, and/or the use, acceptance or possession of a prize, and/or participation (or non-participation) in a prize-related activity.
9.7. The Organiser reserves the right to terminate the Competition at any time with immediate effect. If this is the case, the Organiser will provide a notice on the Website. It shall be the responsibility of entrants to review such Website in this respect. In such event, all entrants hereby waive any rights which they may have against any of the Organiser Parties and acknowledge that they will have no recourse or claim of any nature against the Organiser Parties.
9.8. The Organiser is not liable for any technical failure that may result in an entry not being successfully submitted and/or selected.

9.10. Where relevant:
9.10.1. if a winner does not accept or is deemed to not accept any prize as required herein;
9.10.2. if an entry is not valid for whatever reason;
9.10.3. if a winner has breached these Rules and/or any other competition rules and/or any agreement between the Organisers and the entrants;
9.10.4. if a winner renounces the prize or we deem such winner to have renounced the prize,
we reserve the right to declare the Prize forfeited and/or choose a new Winner.
9.11. Nothing in these Rules is intended to, or must be understood to, unlawfully restrict, limit or avoid any rights or obligations, as the case may be, created for either the entrants or the Organisers in terms of the Consumer Protection Act, 68 of 2008.
9.12. The duration of this Competition may also be extended or curtailed at the sole discretion of the Organiser. If this is the case, the Organiser will provide notice of this on the Website.
