Important clauses which may limit our responsibility, place an obligation on you to indemnify us, involve an acknowledgment of any fact or involve some risk for you will be in bold and italics. You must pay special attention to these clauses.
1. INTRODUCTION
1.1 The Tropika Island of Treasure 7 Competition (“Competition“) is being run by Clover S.A Proprietary Limited, Registration Number 1994/001064/07 (“Organiser/we/us/our”).
1.2 Each person entering the Competition (“participants/entrants/you/your”) and/or accepting any prize in terms of this Competition, agrees and accepts that the Competition rules as set out in these terms and conditions (“Rules”) is binding on him or her.
1.3 Copies of these Rules are available online at www.clover.co.za (“the Website”) or at Clover Park, 200 Constantia Drive, Constantia Kloof.
2. COMPETITION PERIOD
2.1. The Competition commences at 00:01 on 1 July 2016 and will close at 23:59 on 30 September 2016 (“CompetitionPeriod”). No entries received after the end of the Competition Period will be considered.
3. WHO CAN ENTER
3.1. In order to be eligible to enter the Competition you must:
3.1.1 be a legal, permanent resident of the Republic of South Africa;
3.1.2 be in possession of a valid identity document with a 13 (thirteen) digit identity number;
3.1.3 be 18 (eighteen) years old or older on the date you enter or, if you are younger than 18 (eighteen) years of age, you must be assisted to the extent necessary by a parent/legal guardian;
3.1.4 be a natural person; and
3.1.5 not be barred or disqualified by any authority from taking delivery and transfer of the Prize or any portion thereof.
3.2 Notwithstanding clause 3.1, you are not eligible to enter this Competition if:
3.2.1 you are a director, member, partner, employee, agent or consultant of the Organisers, or any other person who directly or indirectly controls or is controlled by the Organisers;
3.2.2 you are an immediate family member of any of the persons specified in clause 3.2.1; or
3.2.3 you are a supplier of goods or services in connection with the Competition.
4. HOW TO ENTER
4.1. Purchase a promotional pack of Tropika (“the Product”);
4.2. Dial the USSD (Unstructured Supplementary Service Data) code (*120*8767*last4digitsofthebarcode#) as stipulated on the Product, that was purchased by you, from a mobile phone.
4.3. Once you have entered the requested combination of digits, you will be prompted to answer “YES” or “NO” to whether you wish to be considered for the Tropika Island of Treasure 7 Contestant Auditions (“Auditions“). If you select “NO”, your entry to the Competition will be complete and you will stand a chance of being randomly drawn as a winner. If you select “YES” you will be prompted to indicate 1 (one) of 7 (seven) celebrities who’s Audition you would like join as well as have the opportunity to say “No Thanks” if you do not wish to compete. Once you have selected the celebrity, your entry will be complete and you will stand a chance of being randomly drawn as a winner. PLEASE REFER TO CLAUSE 7 BELOW FOR RULES REGARDING TROPIKA ISLAND OF TREASURE 7 CONTESTANT AUDITIONS & PARTICIPATION.
4.4. You may enter the Competition as many times as you like, provided you use a unique Product barcode number for each entry. (i.e. One entry per Product purchased)
4.5. You must be able to produce a valid till slip as proof of purchasing the Product with the relevant barcode used for the entry if requested by Clover.
4.6. Each entry will be charged at 20c (twenty cents) per 20 (twenty) seconds. Free minutes do not apply. Cost of each entry will however not exceed R1.50 (one rand and fifty cents) in total.
5. DETERMINATION OF AIRTIME & CASH WINNER AND PRIZES
5.1. Winners will be drawn randomly from correct entries received by means of a instant automated system throughout the Competition Period. Winners are therefore determined instantly on completion of their entries.
5.2. Entrants stand a chance to either win a share of R 400 000.00 (four hundred thousand rand) worth of airtime prizes (“Airtime Prizes“), or to win a share of R 100 000.00 (one hundred thousand rand) in cash prizes (“Cash Prizes“), subject to 5.3 below.
5.3. The Airtime Prizes will be awarded in denominations of R 5.00 (five rand) worth of airtime per winning entry and the Cash Prizes will be awarded in denominations of R 1 000.00 (one thousand rand) per winning entry.
5.4. The Competition prizes are not transferrable from the prize winners to any other person and may not be exchanged for its cash value, except if otherwise stipulated in these Rules.
6. DELIVERY OF AIRTIME & CASH PRIZES
6.1. For Airtime Prizes:
6.1.1. Winners of the Airtime Prizes will receive an instant SMS notification of the value of the airtime they have won on the cellular phone number used for entering. Airtime Prizes may be redeemed by PRE-PAID account holders of the following networks only – Vodacom / MTN / Cell C / Virgin Mobile and 8ta. An SMS with the airtime voucher with dial-in instruction on how to redeem the airtime will be sent to the cellular phone number used to enter the Competition.
6.1.2. Winners with contract accounts can transfer the Airtime Prize to any other Pre-Paid number of their choice (by SMSing the winner SMS to the desired recipient), provided that Pre-Paid number is on the same network.
6.2. For Cash Prizes:
6.2.1. Winners of Cash Prizes will be notified instantaneously via 2 (two) SMS’s – one from TMARC confirming the fact they have won, and one from ABSA within 48 hours from completing his/her entry. The TMARC SMS will confirm the amount and will provide an Authorisation PIN of 6 (six) digits. The ABSA SMS will provide a 10 (ten) digit Withdrawal Access Number as well as the amount. Winners must go to any ABSA ATM, select the CASHSEND Option and follow the prompts. Both the Authorisation PIN and the Withdrawal Access Number are required to complete the transaction.
6.2.2. Once TMARC and ABSA have confirmed the dispatch of codes to the winning number and confirmed the redemption of the cash from the ABSA ATM, the consumer will have no further claim against the Organiser or its agents regarding the Prize. If the winner did not personally withdraw the money, the winner must open a case with ABSA or the South African Police Services to investigate further.
7. TROPIKA ISLAND OF TREASURE 7 CONTESTANT AUDITIONS & PARTICIPATION
7.1. If you selected “YES” to being considered for the Auditions when you enter the Competition, you will automatically be included in a draw to be shortlisted as a possible contestant for the Tropika Island of Treasure 7 television series (“TIOT 7“).
7.2. Please note, if you selected “NO” to being considered for the Auditions when entering the Competition, you will not be prompted to answer “YES” or “NO” to whether you wish to be considered for the Auditions on future entries. You will however still have the opportunity to make yourself available for the Auditions by dialling the unique dial code listed in 7.5 below for the celebrity contestant (“Celebrity”) who’s team you wish to audition for, should you later wish to be available for the Auditions.
7.3. If you dial the Celebrity dial code, you will be prompted to go in store to buy a Product and to dial the *120*8767*last4digitsofthebarcode#. If you have previously entered the Competition and said “NO” to the Auditions, but now made yourself available via the Celebrity dial code, you do not need to buy another Product and you are entered for the Competition and for the Auditions. If you have not previously purchased a Product when dialing the Celebrity dial code, you must first purchase a Product to get a barcode and dial *120*8767*last4digitsofthebarcode#, before you will be included for the Auditions as well as the Competition draws.
7.4. Summary of possible Scenarios:
7.4.1. I buy my Tropika (the Product) in store and enter (*120*8767*last4digitsofbarcode#) and opt “YES” for the Auditions (this is asked as a question when I enter the Competition) – I now stand a chance to win an Airtime Prize and Cash Prize AND I am in the draw for the Audition process.
7.4.2. I buy my Tropika (the Product) in store and enter (*120*8767*last4digitsofbarcode#) and opt “NO” for the Auditions – I now stand a chance to win an Airtime Prize and Cash Prize BUT will not be contacted for the Auditions.
7.4.3. I buy my Tropika (the Product) in store and enter (*120*8767*last4digitsofbarcode#) and opt “NO” for Auditions, but then see my favourite Celebrity on social media will be competing on the island and I change my mind. I then enter via the Celebrity dial code (*120*642*CELEBCODE#) – I will stand a chance to win an Airtime Prize and Cash Prize AND will be opted in to go into the draw for the Auditions (even though I am prompted to go in store and buy the Product each time I enter via a Celebrity dial code).
7.4.4. I see my favourite Celebrity on social media asking me to vote to join their team on the island and enter via his/her dial code (*120*642*CELEBCODE#) – The system will now WAIT for me to purchase my Tropika (the Product) and dial (*120*8767*last4digitsofbarcode#) before my entry will be included into the draw for the Auditions.
7.4.5. What if I have selected multiple celebs? If your name is drawn for the Auditions you will be asked to confirm your choice during the telephonic interview. This will be your final opportunity to confirm your Celebrity choice.

7.6. In order to be considered for the Auditions and/or to participate in TIOT 7, you must:-
7.6.1. be a legal, permanent resident of the Republic of South Africa;
7.6.2. be in possession of a valid identity document with a 13 (thirteen) digit identity number;
7.6.3. be 18 (eighteen) years of age or older in order.
7.6.4. have a valid Passport, which shall remain valid for at least 6 (six) months from 23 October 2016 and has at least 2 (two) clear pages.
7.6.5. not be barred from travelling to the Seychelles or from any airline, accommodation or activity in the Seychelles.
7.6.6. be available to travel to and to participate in TIOT 7 in the Seychelles from 23 October 2016 until 6 November 2016
7.6.7. be able to swim in open water without assistance
7.6.8. be of good health and not have any limiting medical conditions that will prevent you from participating in the activities on the island (such as: alcoholism, heart problems, bleeding disorder, pregnancy).
7.6.9. not have a criminal record
7.7. By selecting to make yourself available to be considered for the Auditions, you consent to your name and contact details being processed by the Organisers for purposes of the TOIT 7 audition process.
7.8. You acknowledge that the Auditions may be filmed by the Organisers and that the Organisers may use such material for publicity purposes and/or to broadcast as part of TIOT 7. By participating in any of the Auditions you agree to be filmed, recorded and/or photographed during your participation in the Auditions (“your participation”) and acknowledge that the Organisers will own the copyright to any such material which may include your participation (‘your contribution”). You irrevocably agree to the Organisers using, editing, broadcasting, publishing and/or exploiting your contribution in any media in perpetuity throughout the world.
7.9. TIOT 7 Contestants who are determined by the Organisers from the Auditions will compete with the celebrity contestant (“Celebrity“) – who they selected to partner with on their entry – in the Seychelles for a R 1 000 000.00 (One Million Rand) cash prize during the TIOT 7, which prize will be shared on a 50/50 bases between the two persons making up the winning pair.
7.10. Determination of the TIOT 7 Contestants
7.10.1. STEP 1:
The Organisers will randomly draw names from all persons who selected to make themselves available for the Auditions from time to time over the Competition Period. The Organisers will contact the persons whose names are drawn on the cell phone numbers from which the entries were sent and conduct a telephonic interview and go through a pre-screening set of questions with each.
7.10.2. STEP 2:
The Organisers will host 3 (three) road shows (“Road Shows“) where auditions will be held. The Road Shows will be held in Durban 2 October 2016, in Cape Town on 4 October 2016 and in Johannesburg on 6 October 2016.
The Organisers will invite 20 (twenty) persons per Celebrity – from persons who selected each Celebrity on their entries – to attend each Road Show for auditions, which persons will be selected at sole and unfettered discretion of the Organisers. I.e. 140 (one hundred and forty) persons will be selected to attend each Road Show, based on the Road Show which is closest to them. Each person will be responsible for his/her own cost to attend the Road Show. The Organisers will appoint a panel of Judges who will judge the auditions and who will select a total of 5 (five) persons per Celebrity from all the auditions from the 3 (three) Road Shows, who will be determined in their sole and unfettered discretion.
7.10.3. STEP 3:
The 35 (thirty-five) persons selected from the Road Shows (i.e. the 5 (five) persons per Celebrity) will be invited to attend a final audition with the Celebrities and other judges in Johannesburg on 9 and 10 October 2016.
The Organisers shall provide flights for such persons to attend the said audition where necessary. The selected persons must however cover their own airport transfers to the venue and any other costs to attend the final auditions.
The Organisers will appoint a panel of judges who will, with the Celebrities, select 1 (one) person per Celebrity from the groups of 5 (five) finalists per Celebrity who will be invited to participate in TIOT 7 with the Celebrity. The said persons will be determined in their sole and unfettered discretion of the judges and Celebrities.
7.10.4. The Organisers reserves the right to select a different entrant should any selected entrant for any reason be unable or unwilling to attend either the Road Show, the final audition in Johannesburg or the TIOT 7 production in Seychelles, or for any reason fail for reply timeously to any such invitation and the Organisers and/or their agents shall not be liable for any claims as a result of withdrawing its invitation.
7.11. Participation in TIOT 7
7.11.1. Should you be invited as a contestant for TIOT 7, you will be provided with a Contestant Participation Agreement that will stipulate the specific terms and conditions for participation in TIOT 7. Your participation TIOT 7 will be subject to you agreeing to and signing the Participation Agreement.
7.11.2. TIOT 7 will be filmed from 23 October 2016 to 6 November 2016 in the Seychelles and the final event will be broadcast live from Cape Town in 2017.
8. GENERAL TERMS
8.1. The Organiser may in its sole discretion amend these Rules at any time, without notice, and such amendment(s) shall be deemed to have taken effect from the date of publication of the revised Rules on the Website.
8.2. The Organiser will interpret the Rules in their sole discretion and reserve the right to amend the Rules at any time should it be deemed necessary ion the sole and unfettered discretion of the Organisers.
8.3. If you are not eligible to enter the Competition in terms of clause 3 above, you will forfeit any prize that may be allocated to you in terms of this Competition. The Organisers reserve the right to request you to provide necessary proof that you have met the eligibility requirements. Should you fail to provide such proof within a reasonable time, you will be disqualified and any prizes will be forfeited and returned if applicable.
8.4. The Organiser may collect, store and use any personal information of entrants and/or other participants for communication or statistical purposes. By entering the Competition, you expressly consent to the aforesaid use.
8.5. IN THE EVENT OF A DISPUTE, THE DECISION OF THE ORGANISER WILL BE FINAL AND BINDING AND NO CORRESPONDENCE WILL BE ENTERED INTO. IN THIS REGARD AND FOR FURTHER CLARITY, THE ORGANISER SHALL BE ENTITLED TO DEAL WITH SUCH DISPUTES (OR ANY FAILURE BY PARTICIPANTS TO FOLLOW THE RULES) IN THEIR SOLE DISCRETION, INCLUDING THAT THE ORGANISER SHALL BE ENTITLED, IN ADDITION TO ANY OTHER RIGHTS WHICH THE ORGANISER MAY HAVE IN TERMS OF THESE RULES AND/OR THE GENERAL COMPETITION RULES, TO IMMEDIATELY DISQUALIFY PARTICIPANTS FROM THIS COMPETITION.
8.6. BY ENTERING THE COMPETITION AND/OR ACCEPTING ANY PRIZE, THE ENTRANTS, USERS AND/OR WINNERS HEREBY INDEMNIFY, RELEASE AND HOLD HARMLESS THE ORGANISER (INCLUDING ITS SUBSIDIARIES, HOLDING COMPANIES AND AFFILIATES), ITS DIRECTORS, EMPLOYEES, AGENTS, SUPPLIERS AND CONTRACTORS (THE “ORGANISER PARTIES”) FROM AND AGAINST ANY ACTIONS, CLAIMS AND/OR LIABILITY FOR INJURY, LOSS, DAMAGE, EXPENSE, CLAIM OR DAMAGES OF ANY KIND RESULTING IN WHOLE OR IN PART, DIRECTLY OR INDIRECTLY, FROM PARTICIPATION IN THE COMPETITION, AND/OR THE USE, ACCEPTANCE OR POSSESSION OF A PRIZE, AND/OR PARTICIPATION (OR NON-PARTICIPATION) IN A PRIZE-RELATED ACTIVITY.
8.7. THE ORGANISER RESERVES THE RIGHT TO TERMINATE THE COMPETITION AT ANY TIME WITH IMMEDIATE EFFECT. IF THIS IS THE CASE, THE ORGANISER WILL PROVIDE A NOTICE ON THE WEBSITE. IT SHALL BE THE RESPONSIBILITY OF ENTRANTS TO REVIEW SUCH WEBSITE IN THIS RESPECT. IN SUCH EVENT, ALL ENTRANTS HEREBY WAIVE ANY RIGHTS WHICH THEY MAY HAVE AGAINST ANY OF THE ORGANISER PARTIES AND ACKNOWLEDGE THAT THEY WILL HAVE NO RECOURSE OR CLAIM OF ANY NATURE AGAINST THE ORGANISER PARTIES
8.8. THE ORGANISER IS NOT LIABLE FOR ANY TECHNICAL FAILURE THAT MAY RESULT IN AN ENTRY NOT BEING SUCCESSFULLY SUBMITTED.
8.9. ANY PRIZE IS ACCEPTED BY A WINNER AT HIS/HER OWN RISK AND THE ORGANISER IS NOT LIABLE, AT ANY TIME, FOR ANY DEFECT IN THE PRIZE.
8.10. Where relevant, if a Winner does not accept the Prize as required herein, if an entry is not valid for whatever reason, if a Winner has breached these terms and conditions, if a Winner renounces the Prize or we deem such Winner to have renounced the Prize, we reserve the right to declare the Prize forfeited and/or choose a new Winner.
8.11. Nothing in these terms and conditions is intended to, or must be understood to, unlawfully restrict, limit or avoid any rights or obligations, as the case may be, created for either the entrants or the organisers in terms of the Consumer Protection Act, 68 of 2008.
8.12. The duration of this Competition may also be extended or curtailed at the sole discretion of the Organiser. If this is the case, the Organiser will provide notice of this on the Website.
8.13. All Competition queries must be directed to 083 913 4041 between 08h00 to 16h30. VAS rates apply. Free minutes do not apply.
